Collector Terms of Service
Proposed English controlling master. Version: collector-terms-en-2026-10-27-review-2.
1. Parties and scope
These proposed Collector Terms are between Fanz Cards USA LLC (“Fanz Cards”, “we”, “us”) and the person creating or using a Collector account (“you”). Fanz Cards USA LLC is a Delaware limited liability company whose registered office is 131 Continental Dr, Suite 305, Newark, Delaware 19713, New Castle County, United States. These Terms govern Collector accounts, primary purchases from Fanz Cards and use of the Fanz.Cards platform. A Creator’s separate Supplier Agreement is not part of these Collector Terms.
2. Supplier and reseller model
Creators supply authorized digital-card content to Fanz Cards under separate arrangements. Fanz Cards packages and offers eligible Cards to Collectors as reseller and seller. A Creator is not your contractual seller merely because the Creator appears on a Card, and a Creator does not receive your payment credentials. The identity and role shown at checkout for the particular transaction controls if it differs from this general description.
3. Stripe Managed Payments
For a transaction expressly identified at checkout as using Stripe Managed Payments, Sold through Link, LLC (“SMP”), a Stripe affiliate, acts as merchant of record for that transaction. Under Stripe’s current published terms, Fanz Cards remains the Seller, SMP is not the seller of record and does not possess the digital product, and SMP facilitates the sale on Fanz Cards’ behalf. SMP may provide checkout, receipts, payment collection, indirect-tax handling in supported jurisdictions, fraud and dispute management, transaction support, and refunds under its own applicable terms. Transactions not expressly identified as Stripe Managed Payments must display their applicable seller, payment and tax roles at checkout. This draft does not represent that Stripe Managed Payments has been activated.
4. Account eligibility and security
You must have legal capacity to contract and meet the minimum age and territorial requirements applicable to you. You must provide accurate information, keep one personal account unless we approve another arrangement, protect your credentials, and promptly report suspected compromise. You may not sell, share or transfer an account. No guest checkout is offered. You must sign in and have accepted every then-active document required for checkout before starting a purchase.
5. Cards, ownership and access
A “Card” is a digital collectible and its expressly listed content or benefits. A “Card Instance” is the numbered or otherwise individually recorded unit assigned to your account. Ownership means the Platform records your entitlement to that Instance and the associated contractual access. It does not transfer copyright, trademark, publicity rights, a Creator’s identity, company equity, a physical object, a blockchain token, an external wallet asset, or any benefit not stated in the listing.
Subject to payment, these Terms and applicable law, we grant the registered owner a limited, personal, non-exclusive, non-commercial, non-transferable licence to access and privately enjoy the Card content through authorized Platform functions. If an authorized resale transfer completes, access tied solely to that Instance passes to the new owner and ends for the former owner. We may use proportionate technical measures to protect restricted content.
6. Permitted and prohibited use
You may view Card content for personal use and use sharing features we expressly provide. Unless the rights holder separately authorizes it, you may not copy, scrape, download except through an enabled download function, redistribute, publicly perform, rebroadcast, sublicense, sell the content separately from an authorized Card transfer, remove notices, impersonate a Creator, use content commercially, or use Card content or personal data to train or evaluate an artificial-intelligence model.
You must not use the Platform for unlawful, infringing, fraudulent, deceptive, abusive, exploitative, hateful, sexually exploitative, privacy-invasive or security-disruptive conduct. You must not manipulate availability or resale prices, conduct sham or self-dealing transactions, evade sanctions or territorial controls, probe private systems, introduce malicious code, or interfere with another person’s access.
7. Listings, orders and delivery
Before you commit to a paid order, checkout must identify the Card, quantity or edition, price and currency, applicable taxes and charges, material access restrictions, and the transaction roles then in use. An order is completed only after the payment provider confirms successful payment and the Platform records fulfillment. Authorization or a pending payment is not completed ownership. We may reject, cancel or refund an unlawful, unauthorized, suspicious, duplicate, mistaken or unavailable transaction.
Digital delivery normally occurs to My Collection. You are responsible for maintaining access to your account and compatible internet access. If purchased content is not delivered, materially misdescribed, defective, inaccessible for reasons within our control, or charged without authorization, contact support promptly so we can investigate and provide the remedy required by law and the applicable Refund Policy.
8. Continued access and content changes
We aim to preserve lawful access to purchased Card content, but do not promise perpetual or uninterrupted operation. Maintenance, provider failures, security incidents, legal orders, rights claims, safety concerns or service discontinuation may affect access. We may suspend content while investigating and may replace or remove specific unlawful, infringing, unsafe or defective material through a controlled correction process. We will preserve ownership and transaction history and provide notice or an appropriate remedy where required by law. A correction must not silently substitute a materially different product.
9. Resale
Resale is available only where enabled for an eligible Instance and lawful in the relevant jurisdictions. A seller sets the asking price and authorizes transfer if a sale completes. Before confirmation, the Platform must disclose the price, currency and applicable allocation or fee information. We do not promise a buyer, liquidity, appreciation, a minimum resale value or repurchase. A Card is a digital collectible for access and enjoyment, not an investment product.
10. Refunds, disputes and support
The Collector Refund and Support Policy forms part of these Terms. Mandatory rights for non-delivery, defective or misdescribed digital content, unauthorized transactions and statutory cancellation are preserved. Eligible voluntary returns receive a 100% refund with no restocking fee under the MVP return rules stated in the Collector Refund and Support Policy. No contractual restriction overrides non-waivable law.
For a Stripe Managed Payments transaction, SMP’s refund policy controls where it is more generous than ours. Stripe’s current terms state that SMP may issue a refund within 60 days of purchase regardless of a more restrictive seller policy and may refund where law requires. Transaction-related support may be provided through Link. You may also contact Fanz Cards through the support channel shown on the Platform. We may require return or cancellation of the related Card Instance when a refund or rescission is completed.
11. Suspension and closure
We may proportionately restrict an account or transaction for security, fraud, illegality, rights violations, payment disputes, material breach or a binding legal requirement. Where lawful and reasonably safe, we will provide the material reason and a review path. Closing or restricting an account does not erase ownership, completed transactions, acceptance evidence, refunds, chargebacks, audit records or records we must retain. Account inactivity alone does not authorize forfeiture.
12. Privacy
The active Collector Privacy Notice explains how Fanz Cards processes personal data. Stripe, SMP, Link and other providers may process information under their own notices and roles. Acceptance of these Terms is not blanket consent to optional marketing or non-essential tracking.
13. Changes
Every approved version will have a version identifier and effective date. We will not silently rewrite an accepted version. Material changes will be notified as required, and new affirmative acceptance will be requested where required by law or configured as required for future registration or checkout. Historical acceptance evidence remains linked to the exact content hash accepted.
14. Liability and mandatory rights
Nothing in these Terms excludes liability or remedies that cannot lawfully be excluded, including liability for fraud or fraudulent misrepresentation and applicable consumer rights. Subject to those rights, neither party is liable for losses that were not reasonably foreseeable when the contract was formed. Any final monetary limitation of liability requires separate legal and business approval before activation.
15. Governing terms and contact
The final controlling law, forum, minimum-age rule, liability provisions and formal legal-notice contact remain subject to approval. Consumers retain mandatory protections and competent forums available under applicable law. Support contact proposed for Collector matters: support through the Help Center. Formal legal notice details must be approved before activation.
